The protection of your personal data is important to us. Your data will therefore be processed exclusively on the basis of the applicable legal provisions, in particular the Austrian Data Protection Act (DSG), the European Data Protection Regulation (DSGVO) and the Austrian Telecommunications Act 2003 (TKG 2003).

2. What is personal data?

Personal Data is information about data subjects whose identity is determined or at least determinable. All data containing information about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, gender, social security number, IP address, video recordings, photos and voice recordings of persons, are personal data within the meaning of data protection law. Sensitive data, such as health data or data in connection with criminal proceedings, may also be included.


3. For what purpose do we process your data?
We process your data for the following purposes:
Processing and transmission of personal data in the context of the client relationship and also pre-contractual activity concerning (potential) clients, opponents and other parties to proceedings, courts, authorities and suppliers;
Operation and optimization of this website;
Marketing activities: in particular, sending alerts and information on current legal innovations and developments, professional articles from our experts, invitations to events of our cooperation as well as organization of these events;
Evaluating the professional and personal skills of applicants and filling vacancies.

4. Legal bases for data processing
We process those personal data that you provide to us as a user of the website and/or as a potential or existing client. The data processing for all purposes of all above mentioned points is based on the legal grounds of the fulfillment of the contract and/or pre-contractual measures with the respective (potential) clients according to Art 6 para 1 lit b DSGVO, the legal basis of consent according to Art 6 para 1 lit a DSGVO and Art 9 para 2 lit a DSGVO, the legal basis of processing due to a legal obligation pursuant to Art 6 para 1 lit c DSGVO as well as the legal basis of the performance of a task in the public interest pursuant to Art 6 para 1 lit e DSGVO, namely the submission of data to Statistik Austria AG, as well as the assertion, exercise and defense of legal claims pursuant to Art 9 para 2 lit f DSGVO.

If you are already a client of Morgen Advisory Partners GmbH or wish to become one, i.e. if you have an existing contract or wish to conclude one, you are obliged - on the basis of the contract - to provide certain personal data that is necessary in the context of the processing of the mandate. Failure to provide this data would result in our not being able to provide any services.

The data processing for the operation and optimization of this website is based on legitimate interests pursuant to Art 6 para 1 lit f DSGVO, namely our legitimate interest in the operation and optimization of the website and marketing, whereby - with the exception of registrations for newsletters as well as Morgen Advisory Partners GmbH events - the IP address is only partially recorded.  In any analysis of the use of our website, there is no personal allocation.

Data processing for marketing purposes is based on consent pursuant to Art 6 para 1 lit a DSGVO as well as on the legal basis of legitimate interest pursuant to Art 6 para 1 lit f DSGVO, namely the interest in marketing activities and providing information on legally relevant innovations.

Data processing in the context of application procedures is carried out on the legal basis of consent pursuant to Art 6 para 1 lit a DSGVO, pre-contractual measures pursuant to Art 6 para 1 lit b DSGVO and the legal basis of legitimate interest pursuant to Art 6 para 1 lit f DSGVO, namely the interest of checking suitability for the specific position in the company.


5. Recipients of data
Your personal data will not be disclosed to third parties, unless this is necessary for the fulfillment of our obligations and/or required by law/authorities.

However, your personal data is also processed on our behalf by our service providers (processors). These order processors are in particular providers of marketing tools, IT service providers, providers of software solutions and other tools, IT maintenance services and similar services. In this case, the data will only be processed on the basis of our instructions for our purposes outlined here.

Furthermore, the personal data will be disclosed in particular to courts, tax advisors, auditors, tax offices and notaries within the framework of the fulfillment of our purposes presented here.

It may be necessary in the context of the client relationship and pre-contractual activity (potential clients) that personal data is forwarded to other companies outside of Austria as well as outside of the European Economic Area. In these countries, there is sometimes a lower level of data protection than in the European Union.

If we transfer personal data, appropriate safeguards will be provided for the data transfer to ensure adequate protection.


6. Duration of data storage

Personal data whose processing is carried out will only be stored until the purpose for which it is processed has been fulfilled and for as long as we need it to fulfill our contractual and/or legal obligations. When we no longer need your personal data, we delete it from our system and from our records or anonymize it so that you can no longer be identified.

7. Your rights

As a data subject within the meaning of data protection law, you have the following rights in particular:

  • Right to information about your processed personal data;
  • Right to rectification or erasure or to restriction of processing;
  • Right to object to processing;
  • Right to data portability.


If there are any changes to your personal data, we request that you notify us accordingly.

You also have the option of submitting a complaint to a data protection supervisory authority. The data protection supervisory authority responsible for us is the Austrian Data Protection Authority.

If the data processing is based on your consent, you can revoke your consent to data processing at any time in writing (e-mail is sufficient) to matthias.compes@mrgn.at. A revocation does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.


8. Social plugins

There are no social plugins ("plugins") on the website.


9. Links to other websites

This website contains links to other websites. However, the privacy policy described here does not apply to these websites. We therefore request that you visit these websites directly to obtain the data protection information applicable to the respective websites there.

10. Web server protocols
The web server stores only anonymized data. We store the anonymized data for technical reasons and for statistical evaluation and analysis of the use of our website in order to optimize our Internet presence.

11. Web analysis

Our website does not use any functions of a web analytics service.

12. Data security

The security of your data is very important to us. We do our utmost to make your visit and use of our website as safe as possible. Therefore, we comply with the provisions of Article 32 DSGVO to ensure the confidentiality and security of your personal data and take appropriate technical and organizational security measures.

Notwithstanding the efforts of maintaining a reasonably high level of due diligence at all times, it cannot be excluded that information you disclose to us via the Internet may be viewed and used by others.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacker attack on email account or telephone, interception of faxes).
